Like most people, you trust medical professionals to take care of you when you go to the doctor or hospital. But misdiagnosis is common, and many people leave without a diagnosis or with a wrong diagnosis. When this results in serious harm or illness, you may be eligible for compensation.
If you or a family member were misdiagnosed or a doctor failed to diagnose you at all, you have the right to obtain copies of your medical records and to contact a qualified medical malpractice lawyer.
An attorney can help you determine if you have a case and will guide you through the next steps.

In Ohio, the statute of limitations for medical malpractice cases, including misdiagnosis or failure to diagnose, is one year from the date it was discovered. However, Ohio also has a four-year statute of repose, which means you cannot file a claim once four years have passed, regardless of whether the injury was discovered later.
To help prove your case, your misdiagnosis lawyer will hire an expert witness, who is typically a physician who practices the same line of medicine as the doctor in question. They will investigate your claim and determine whether your doctor violated the standard of care governing that field. The standard of care is based on what the average doctor would do if he or she had been faced with the same circumstances.
If the expert witness concludes that your doctor deviated from the accepted standard of good medical practice, they can testify in your case.
