In order to be eligible for the National Vaccine Injury Compensation Program,an Ohio medical malpractice claimant must file a petition with the U.S. Court of Federal Claims that includes the following information:
- who was injured by the vaccine;
- which vaccine caused the injury in question;
- the date the vaccine was administered to the patient;
- the location of the vaccine’s administration;
- the nature of the injury;
- the first symptoms of the injury and when they appeared;
- how long the symptoms and effects lasted; and
- medical records that corroborate your petition claims.
The VICP has a list of vaccines pre-approved for the fund by the Health Resources and Service Administration (HRSA), and as new vaccines are added to the list, those changes are reflected at the HRSA website.
In order to receive compensation from the fund, it must be demonstrated that you (or your child) sustained an injury that was the direct cause of the vaccine and that you sustained some damages as a result.
As opposed to being paid by a private doctor or hospital’s medical insurance provider, you will be paid from the federal VICP fund, which is supported by a small tax assessed on all vaccines.
